Partner terms
These General Collaboration Terms govern the onboarding, participation and use of the Cerrajero Express platform by self-employed professionals and companies engaged in locksmith activity who wish to receive service requests, appear in the professional directory and collaborate with the platform.
Applying for registration, using a professional account and accepting jobs implies awareness and acceptance of these terms, as well as any particular terms that may be set for certain services or collaboration models.
1. Identification of the platform
The owner and operator of the platform is:
Trading name: Cerrajero Express
Tax ID (NIF): B16684748
Address: C. Murillo, 5, 03184 El Chaparral, Alicante, Spain.
Email: info@cerrajero-express.es
Phone: +34 603 563 713
Website: https://cerrajero-express.es
Hereinafter, Cerrajero Express may be referred to as the «Platform» and the self-employed professionals or companies that collaborate with it as the «Partners» or «Professionals».
2. Purpose and nature of the collaboration
Cerrajero Express carries out digital intermediation between people who need locksmith services and independent professionals who can handle those requests.
The platform allows Partners to register, provide information about their activity, appear in a professional directory and receive intervention requests related to work such as:
- Door opening and emergency services.
- Change, installation and replacement of locks and cylinders.
- Repair and maintenance of locking mechanisms.
- Residential, commercial and other related locksmith services.
Cerrajero Express facilitates the receipt, organisation, distribution and follow-up of requests, but does not necessarily perform the technical work and does not act as employer of collaborating professionals.
The Partner who accepts a request is responsible for assessing, organising and performing the technical service, and for maintaining the corresponding professional relationship with the customer.
The platform does not guarantee a minimum volume of requests, a set number of jobs, minimum income or regular assignment of work.
3. Onboarding, registration and verification of Partners
To collaborate with Cerrajero Express, the professional must complete the registration procedure and provide the information required to identify their activity and check their suitability as a collaborator.
The onboarding procedure may include:
- Identification data of the professional or company.
- Trading name and professional contact details.
- Information on services offered and coverage areas.
- Tax and business information needed for the collaboration.
- Documentation evidencing the activity and business.
- Data of representatives or persons authorised to act on behalf of the company, where applicable.
- Bank details needed to manage settlements and payments, where that feature is used.
Cerrajero Express may request business or professional documentation through identity and activity verification procedures, commonly known as KYC (Know Your Customer), to check the legitimacy of the declared activity, prevent impersonation and maintain a reliable professional network.
The Partner declares that the documents submitted are authentic, valid, complete and correspond to their activity. They also undertake to report any change affecting their identity, ownership, representation, tax situation or capacity to provide the services.
Registration is subject to review of the information provided. Cerrajero Express may request clarifications or additional documentation and may reject onboarding applications where verification requirements are not met or there are objective reasons related to the security, legality or reliability of the collaboration.
4. Professional profile and directory presence
Once onboarding is accepted, Cerrajero Express may enable a professional profile for the Partner in the platform directory.
The profile may include information such as:
- Trading name or company name.
- Description of the professional activity.
- Available locksmith services.
- Geographic coverage areas.
- Professional contact details that may be published.
- Photos, logos and other identifying elements.
- Customer ratings or reviews, where this feature exists.
The Partner is responsible for ensuring that published information is accurate, up to date and not misleading. They must hold the rights and authorisations needed to use photos, trademarks, logos and other content they provide.
Cerrajero Express may change aspects of presentation, structure and organisation of the directory for technical, editorial or functional reasons, without unjustifiably altering the professional’s essential information.
Inclusion in the directory does not constitute an official certification, public accreditation, administrative approval or absolute guarantee of the quality of all work performed by the Partner.
5. Receipt, acceptance and management of jobs
Partners may receive locksmith service requests through their professional account or the communication channels enabled by Cerrajero Express.
Requests may contain information relevant to assessing the job, such as:
- Description of the incident or requested work.
- Property location.
- Customer contact details.
- Photos of locks, doors or mechanisms.
- Information on urgency, availability and particular circumstances of the service.
The Partner may freely accept or reject requests received, according to availability, location, specialisation, operational capacity and other professional circumstances.
Receipt of a request does not oblige the Partner to accept it and does not by itself constitute a service contract with the customer.
Once a job is accepted, the Partner must act diligently and keep status information up to date. The platform may use the following operational statuses:
- Pending: request received, awaiting acceptance, rejection or confirmation of handling.
- In progress: job accepted and in coordination, travel or performance.
- Completed: service finished or intervention closed according to the information communicated.
The Partner undertakes to update those statuses reasonably promptly and to report relevant incidents, such as inability to attend, major availability changes, cancellations or lack of agreement with the customer.
6. Professional obligations of the Partner
The Partner is responsible for carrying out their activity in accordance with Spanish law and the administrative, tax, labour, technical and consumer-protection rules applicable to their business.
In particular, they undertake to:
- Provide services with the diligence, competence and quality expected of a professional in the sector.
- Use tools, materials and components suitable for each intervention.
- Respect safety rules, risk prevention and good professional practice.
- Reasonably check that the person requesting opening or intervention is authorised to access the property or commission the work.
- Provide accurate information about their identity, experience, specialisation and availability.
- Respect consumer rights and the terms agreed with each customer.
- Issue quotes, invoices and receipts where legally required.
- Handle complaints and incidents related to their own work.
- Report any circumstance that may affect proper performance of an accepted job.
The Partner alone is responsible for obtaining and maintaining the licences, permits, authorisations, registrations and professional qualifications legally required for their activity.
They must also keep in force civil liability insurance policies and other cover that is mandatory for their activity or reasonably necessary to cover risks arising from their interventions.
Cerrajero Express may request proof of insurance, qualifications and professional documentation where necessary to verify compliance with these obligations.
7. Price transparency and quotes
The Partner undertakes to provide clear, understandable and transparent economic information before performing the work.
When they receive a request, they must assess the circumstances of the job and communicate to the customer, before final acceptance, the price or the conditions for determining it, including where applicable:
- Travel and possible associated costs.
- Labour and possible surcharges for urgency or special hours.
- Materials, locks, cylinders and necessary components.
- Taxes and other applicable items.
- Scope of work included in the quote.
Where the platform provides an automated estimate, a price range or an indicative maximum amount, that information does not replace the professional’s final assessment.
The Partner must respect the economic maximum that has been communicated and accepted as the job limit. If they consider that the work may exceed that maximum, they must inform the customer in advance of the reasons, detail the new amount or quote and obtain express authorisation before performing additional work.
This obligation also applies when technical circumstances not initially identified appear during the intervention or materials not included in the original quote need to be replaced.
It is prohibited to raise the price unilaterally, introduce charges not previously communicated or perform additional work without the customer’s agreement, except in exceptional cases legally allowed.
The Partner must respect consumer-protection rules, commercial transparency and the prohibition of misleading or unfair practices.
8. Photos, notes and documentation of work
The platform may allow Partners to attach photos, comments, work notes and other information related to jobs received.
These elements may be used to:
- Document the state of an intervention.
- Record actions performed and materials used.
- Justify previously accepted quote changes.
- Report incidents to the support team.
- Update the job status.
- Facilitate management of complaints and disputes.
The Partner guarantees that they have sufficient authorisation or legal basis to capture and provide the images and documents they add to the platform.
Photos should be limited to elements needed to document the service. Faces, identity documents, private information, personal belongings or other data unrelated to the intervention must not be captured or shared unnecessarily.
9. Cerrajero Express intermediation commission
For intermediation services provided to Partners, Cerrajero Express applies a platform commission of 15 % according to the commercial terms accepted during onboarding or the particular terms applicable to the professional account.
The commission remunerates intermediation features, receipt and distribution of requests, platform access, job management and other services associated with the collaboration.
The calculation base, included or excluded items and tax treatment of the commission will be communicated in the corresponding commercial terms before they apply. Any change to these economic conditions must be communicated to the Partner before application.
The commission for each operation may appear in account statements or activity summaries available in the professional area.
10. Statements, invoicing and settlements
Cerrajero Express may generate account statements to inform the Partner about activity performed through the platform.
These statements may include, among other data:
- Requests received and jobs completed.
- Amounts associated with managed services.
- Intermediation commissions applied.
- Adjustments or corrections, where applicable.
- Pending amounts and settled sums.
Statements are for information and reconciliation. They do not replace invoices or other accounting documents required by law.
Cerrajero Express will issue the corresponding invoice for commissions and services it bills to the Partner, with applicable taxes.
The Partner is responsible for their own tax and accounting obligations, and for issuing invoices for technical services they provide to their customers where legally required.
Payment and settlement conditions depend on the operational model enabled for each collaboration. Deadlines may be configured in the professional area or set in particular commercial terms accepted by the Partner.
Where Cerrajero Express collects payment for services as part of the intermediation operation, the corresponding commissions may be deducted and the net amount due settled with the Partner according to the communicated procedure.
Where the customer pays the Partner directly, the intermediation commission will be settled through the invoicing and payment mechanism established for that model.
To receive settlements, the Partner must provide correct bank details and keep them up to date when using this feature. Cerrajero Express is not responsible for delays caused by incorrect or incomplete data provided by the professional, without prejudice to applicable legal obligations.
11. Protection of customers’ personal data
The Partner may receive customers’ personal data through the platform, including names, phone numbers, addresses, locations, photos and incident descriptions.
These data must be used exclusively to manage the accepted request, contact the customer, prepare and perform the service, document the intervention and comply with legal obligations arising from the professional activity.
The Partner may not sell, assign, disclose, communicate or use customer data for purposes unrelated to the job without a valid legal basis.
In particular, it is prohibited to:
- Use contact data to send unsolicited advertising or promotions unrelated to the service.
- Add customer data to own commercial databases without an adequate legal basis.
- Provide customer information to unauthorised third parties.
- Publish photos, addresses or information about identifiable interventions without sufficient authorisation or legal basis.
- Retain customer information for longer than necessary or legally required.
Regarding data used by the Partner to organise and perform their own services, they act as an independent controller when they determine their own purposes and means. They must therefore comply with the GDPR and LOPDGDD, provide the corresponding privacy information and handle data subjects’ rights.
If a specific operation means the Partner processes data exclusively on behalf of and under instructions from Cerrajero Express, the parties must first formalise the corresponding processor agreement under Article 28 GDPR.
The Partner must apply appropriate security measures, limit access to data to authorised persons and notify Cerrajero Express without undue delay of any security incident affecting data received through the platform.
Full information on processing by Cerrajero Express is available in the Privacy policy.
12. Confidentiality
The Partner undertakes to keep confidential the information they access as a result of collaborating with Cerrajero Express.
This obligation covers, among other things, commercial information, internal procedures, economic terms, information about other collaborators, business documentation, access credentials, customer data and any non-public information related to platform activity.
The Partner may not disclose or use such information for purposes other than those needed to perform the collaboration, except with express authorisation or where a legal obligation exists.
The confidentiality obligation continues after the commercial relationship ends with respect to all information that remains confidential or whose protection is required by applicable law.
13. Professional independence and absence of employment relationship
The relationship between Cerrajero Express and the Partner is commercial in nature and is established between independent entities or professionals who carry out their respective activities on their own account.
Collaboration does not by itself constitute an employment relationship, partnership, association, franchise, general representation, commercial agency or relationship of subordination between the parties.
The Partner:
- Freely organises their professional activity and means of work.
- Decides their availability and the hours in which they can handle requests.
- May freely accept or reject jobs received.
- Bears their own costs, tools, materials and business structure.
- Is responsible for their own tax, labour and social-security obligations.
- Is not subject to exclusivity, unless a specific and legally valid commercial agreement provides otherwise.
- Bears the economic and business risk of their independent activity.
Job statuses, communication procedures and platform quality requirements serve operational and commercial coordination purposes and do not by themselves integrate the Partner into an employment structure or hierarchical direction of their technical work.
The Partner is not authorised to act in the name of Cerrajero Express, assume obligations on its behalf or conclude contracts for the platform, except with express and limited authorisation.
The legal characterisation of the relationship will in any event depend on the actual circumstances in which the activity is carried out and the criteria of Spanish labour and commercial law.
14. Quality, complaints and professional liability
The Partner is responsible for proper performance of the work they accept, and for damage arising from their own acts or omissions under applicable law.
They must handle customer queries and complaints related to the intervention performed, provide information on quotes and invoices and respect the corresponding legal and contractual warranties.
Where the platform receives a complaint, it may ask the Partner for information about the job, photos, work notes, quotes, receipts or any other documentation needed to understand and manage the incident.
The Partner undertakes to cooperate in good faith in resolving complaints and to provide accurate and sufficient information.
Customer reviews and ratings may be used as information about user experience. The Partner nevertheless has the right to report incidents or request review of ratings they consider false, unlawful or contrary to the terms of use.
15. Proper use of the platform
The Partner undertakes to use Cerrajero Express exclusively for legitimate professional purposes and in accordance with these terms.
It is prohibited to:
- Provide false documentation or impersonate another professional or company.
- Manipulate requests, job statuses, ratings or economic information.
- Use customer data for unauthorised purposes.
- Attempt to access accounts, systems or information of other collaborators.
- Introduce malicious code or take actions that compromise platform security.
- Publish misleading information about qualifications, authorisations, insurance or professional experience.
- Use the platform for unlawful activities or activities contrary to consumer rights.
- Fraudulently evade agreed commissions on jobs originated and managed through the platform.
Breach of these obligations may result in warning, review, suspension or termination of the collaboration.
16. Suspension and termination of the collaboration
Cerrajero Express may temporarily suspend the Partner’s access or terminate the collaboration where there are justified reasons, especially in the following cases:
- Serious or repeated breach of these terms.
- False, incomplete or irregular documentation during verification.
- Lack of legally required authorisations or insurance.
- Fraud, impersonation or manipulation of operations.
- Misuse or unauthorised disclosure of customer data.
- Serious or repeated complaints evidencing risks for users.
- Breach of economic or invoicing obligations.
- Actions that compromise the security, reputation or operation of the platform.
Where circumstances allow, Cerrajero Express will communicate the reason for the measure to the Partner and offer the opportunity to provide clarifications or remedy the breach within a reasonable period.
In situations involving immediate risk to users, customers, personal data or systems, a preventive suspension may be applied without delay, without prejudice to later communication of its reasons.
The Partner may also request termination of the collaboration by contacting info@cerrajero-express.es, respecting pending commitments, settlements and legal document-retention obligations.
Termination does not extinguish pending amounts, confidentiality obligations, liability for work performed or data-protection obligations that must continue.
17. Intellectual property and Partner content
Cerrajero Express’s own content, including its designs, logos, texts, software, structure and features, is protected by intellectual and industrial property law.
The Partner acquires no ownership rights over these elements merely by using the platform.
The Partner retains the rights they hold over their trademarks, photos, commercial texts and other materials provided. They nevertheless authorise Cerrajero Express to reproduce and display them on a non-exclusive, limited and royalty-free basis for as long as needed to publish their profile, manage jobs and promote the services offered within the platform.
This authorisation does not allow use of the content for purposes unrelated to the collaboration and does not amount to a definitive transfer of the Partner’s rights.
18. Information protection and account security
The Partner is responsible for keeping access credentials protected and ensuring that only authorised persons use their professional account.
They must notify Cerrajero Express of any loss of credentials, unauthorised access, technical incident or circumstance that may compromise the security of the account or of customer data.
Cerrajero Express may adopt reasonable technical and organisational measures to protect the platform, limit improper access and maintain the integrity of information.
19. Changes to these terms
Cerrajero Express may amend these terms due to regulatory, technical, operational or commercial changes, including new features, service models or collaboration procedures.
Amendments will be communicated to Partners through available contact means or via the professional area where appropriate.
Changes affecting commissions, economic terms or essential elements of the collaboration must be communicated before they apply, allowing the Partner to learn of them and decide whether to continue using the services under the new terms.
Continuing the collaboration after the changes take effect may imply acceptance where that is legally valid and the corresponding information has been provided.
20. Applicable law and jurisdiction
These terms are governed by Spanish law and applicable rules of European Union law.
In particular, the Civil Code, commercial law, Law 34/2002 on information society services and electronic commerce (LSSI-CE), Regulation (EU) 2016/679 (GDPR), Organic Law 3/2018 (LOPDGDD) and other provisions corresponding to the nature of each commercial relationship apply.
For any dispute arising from the interpretation, application or performance of these terms, where both parties act in the course of their respective business or professional activities and such submission is legally admissible, the parties submit to the Courts and Tribunals of Alicante, expressly waiving any other forum that might otherwise apply.
This clause does not apply where a mandatory rule establishes a different forum or limits the possibility of submitting the dispute to the indicated courts.
21. Contact and legal documentation
For any enquiry related to onboarding, economic terms, jobs, settlements, complaints or operation of the professional collaboration, the Partner may contact Cerrajero Express through:
- Email: info@cerrajero-express.es
- Phone: +34 603 563 713
- Postal address: C. Murillo, 5, 03184 El Chaparral, Alicante, Spain.
- Website: https://cerrajero-express.es
Information on processing of collaborating professionals’ personal data is available in the Privacy policy.
Identification details of the operator, legal information and the general website terms of use can be found in the Legal notice and the Terms of use (customers).
Acceptance of these terms forms the general framework of collaboration between Cerrajero Express and the Partner, without prejudice to particular commercial agreements that may be set for certain features, areas, jobs or settlement models.
